YOUfilm Equipment Rental Agreement
Parties
This Equipment Lease Agreement ("Agreement") is made between:
YOUfilm Weddings ("Lessor")
Client ("Lessee") – the person who books or purchases a YOUfilm package from www.youfilmweddings.com
Collectively referred to as the "Parties."
By purchasing a YOUfilm service or package, Lessee agrees to be bound by the terms and conditions outlined in this Equipment Lease Agreement.
1. Purpose
Lessor agrees to lease camera equipment to Lessee for the purpose of filming content as part of the YOUfilm wedding or event services. Equipment may include, but is not limited to, video cameras, microphones, lights, and other accessories.
2. Term
The rental term begins when the parcel carrier first attempts to deliver the equipment to Lessee and ends 72 hours after the event date. Kits are typically shipped 10–14 days before the event. Lessee agrees to ship the camera(s) back using the prepaid return label provided. Failure to do so within 72 hours may result in a late fee.
3. Payment
Payment is due in full at time of booking. Equipment will not ship until payment is received. No deposit is required unless otherwise communicated.
4. Use of Equipment
Lessee agrees to operate the equipment responsibly, per the instructions provided. Lessee is liable for any damage due to misuse, neglect, or loss. Normal wear is expected.
5. Delivery & Return
Lessor will deliver the equipment to the shipping address provided by Lessee. A prepaid return label will be included. Lessee is responsible for dropping the return package off at any USPS location within 72 hours of the event date.
Late return may incur a $25/day fee unless previously approved.
6. Damage or Loss
Lessee agrees to notify Lessor immediately of any non-functioning or damaged equipment upon receipt. Lessee is responsible for repair or replacement costs due to damage, loss, or theft during the rental period.
7. Ownership
All equipment remains the property of YOUfilm Weddings and is not for resale or transfer.
8. Age Requirement
Lessee must be 18 years or older to rent and be responsible for the equipment.
9. Cancellations & Refunds
Cancellations made more than 30 days before the event will receive a full refund. Cancellations made less than 30 days before the event will be subject to a 50% cancellation fee. No refunds will be given once equipment has shipped.
10. Model Release
The Lessee agrees to allow the Lessor to retain the right in all cases to use the wedding edit on her website and social media for the purposes of advertising or otherwise promoting their work.
11. Creative License and Artistic View
Lessor has full creative control over the editing of footage. The footage is edited at the Lessor’s discretion, and delivered files may not include all uploaded videos.
12. Limitations on Performance
Lessor shall not be held responsible for videos not taken or missed or for lack of coverage included in the uploads. Lessee agrees to hold Lessor harmless for the impact any lack of coverage, angle, or sound/video quality may have on the finished product.
13. Limitations on Damages
Should Lessor fail to deliver the wedding edit for any reason, including but not limited to loss or damage due to computer malfunction, server error, or failure to upload, the Lessee’s sole remedy shall be a refund in the amount of any payment already received by the Lessor. Any such refund shall be made exclusively to the party who paid the original retainer.
14. Governing Law
This Agreement shall be governed by the laws of the State of California. Any disputes shall be resolved in the courts of Los Angeles County, CA.
